Prop firm payouts and tax in Australia

There is no ATO guidance on prop-firm payouts. If the trader is carrying on a business, the payouts are sole-trader business income reported in the Business and professional items (BPI) schedule. If not, payouts for services are still assessable income, reported as other income. The payouts are not capital gains, because the trader's own capital is not at risk.

Usually taxed as: business incomeNo specific ruling — general rules appliedTax year: 1 Jul – 30 Jun

The Australia tax office has not ruled on prop-firm payouts specifically. The treatment below applies the general rules for this kind of income. Basis: ATO item 24 instructions: amounts for providing services are 'assessable income, even if you aren't carrying on a business'. Where a business is carried on, income goes at P8 of the BPI schedule.

Registration, costs and currency

Registering
A tax file number (TFN) is needed to lodge. No separate income-tax registration is needed to declare business income. GST registration is required when GST turnover is $75,000 or more. Sources: ato.gov.au ; ato.gov.au
Challenge fees and other costs
Deductible: likely. If carrying on a business, expenses incurred in earning the income are claimed at P8. If not, related expenses are claimed at D15 against item 24 income. No ATO statement on challenge fees specifically.
Converting to AUD
Convert at the rate prevailing at the time of the transaction, or at an average rate. The ATO publishes RBA-sourced daily, monthly and annual average rates. Another reasonable external rate may be used for currencies the ATO does not list.
Forms the firm sends you
Foreign prop firms do not report to the ATO and issue no Australian payment summary. The trader self-reports. No ATO source found on domestic prop firms issuing statements.
VAT / GST
GST registration is required at $75,000 GST turnover. Sales 'not connected with Australia' are excluded from GST turnover. A service is GST-free where the recipient is a non-resident not in Australia when the supply is made, or where the service is used or enjoyed outside Australia. A service provided in Australia is not GST-free. How a service performed in Australia for a foreign firm is classified under s38-190 is not confirmed. Sources: ato.gov.au ; ato.gov.au

What to watch out for

  • Resident rates only. Foreign-resident and working-holiday rates differ.
  • Medicare levy surcharge (for higher earners without private hospital cover) is not modelled.
  • Do not claim payouts are capital gains, or that the ATO has issued prop-firm guidance.
  • Business vs non-business status affects where income is reported and loss treatment (non-commercial loss rules). Not modelled.
  • PAYG instalments may be issued by the ATO after the first return showing business income. Not modelled.

Not yet confirmed from an official source

We list these so you know exactly what to double-check.

  • The Medicare levy shade-in rate of 10% of the excess over the lower threshold is the statutory phase-in. The ATO page fetched did not state it explicitly; it is consistent with upper = 1.25 × lower.
  • 2026-27 Medicare levy low-income thresholds are not published yet.
  • The LITO page does not label a year (last updated 8 Jun 2026). It is assumed to apply to 2025-26 and 2026-27.
  • GST-free status of a service performed in Australia for a foreign prop firm is not confirmed.
  • Payment due dates are indicative (later of 21 days after the due date or the NOA).
