Prop firm payouts and tax in Germany
The BMF and BFH have issued no guidance on prop-firm payouts. The payouts are fees or profit shares paid by the firm for an independent, ongoing activity pursued for profit. They are not Kapitalerträge (no own capital) and trading is not a Katalogberuf under § 18 EStG, so the general rules point to Einkünfte aus Gewerbebetrieb (§ 15 EStG), reported on Anlage G with an EÜR. This also brings Gewerbesteuer with the § 35 credit. A minority view (§ 22 Nr. 3 sonstige Leistungen for occasional activity) exists. Anlage S does not fit, because the activity is not a freier Beruf.
The Germany tax office has not ruled on prop-firm payouts specifically. The treatment below applies the general rules for this kind of income.

Registration, costs and currency
- Registering
- If gewerblich: Gewerbeanmeldung at the Gemeinde (§ 14 GewO), then the Finanzamt issues a Steuernummer after the Fragebogen zur steuerlichen Erfassung (via ELSTER). Source: secondary (accountable.de); statutory references not fetched.
- Challenge fees and other costs
- Deductible: likely. As Betriebsausgaben in the EÜR, because the fees are incurred for the gewerbliche activity. No official guidance names them. Refunds are Betriebseinnahmen or reduce the expense.
- Converting to EUR
- Not verified from an official source. Common practice: convert at the rate on the day of receipt (ECB/Bundesbank reference rates) or the BMF monthly Umsatzsteuer-Umrechnungskurse, applied consistently.
- Forms the firm sends you
- German firms: none found. Foreign prop firms do not issue German tax certificates, and payouts are not Kapitalerträge, so no Steuerbescheinigung exists. Reporting is fully self-assessed.
- VAT / GST
- The payout is consideration for a service to the firm. B2B place of supply is the recipient's seat (§ 3a Abs. 2 UStG). For a firm in an EU state, the service is not taxable in Germany and falls under reverse charge in the recipient state, with a ZM required. For a third-country firm (US, UAE), it is not taxable in Germany. Kleinunternehmer (§ 19 UStG, from 2025): prior-year turnover <= €25,000 and current-year <= €100,000. Non-taxable foreign services likely do not count toward Gesamtumsatz, but this is not confirmed. Sources: accountable.de ; ihk.de
What to watch out for
- zvE ≠ profit. The estimate should state that it ignores Sonderausgaben, Vorsorgeaufwendungen (incl. Kranken-/Pflegeversicherung, which reduce zvE substantially), other income and Kirchensteuer (8/9%, not modelled).
- Hebesatz varies by Gemeinde; require user input. With Hebesatz <= ~400% the § 35 credit largely offsets Gewerbesteuer, but not exactly (cap rules).
- Gewerbesteuer is not deductible as a Betriebsausgabe (§ 4 Abs. 5b EStG; not re-fetched).
- Do not claim payouts are Kapitalerträge with Abgeltungsteuer 25%. No own capital is invested.
- Do not claim an official BMF/BFH classification exists. Gewerbe/Anlage G is the general-rules default, not a ruling.
- Soli-Freigrenze joint amount applies on Zusammenveranlagung.
Not yet confirmed from an official source
We list these so you know exactly what to double-check.
- Classification as § 15 Gewerbe (Anlage G) vs § 22 Nr. 3 vs § 18: no official source. Only a commercial blog (Accountable) was found.
- Hebesatz minimum: current gesetze-im-internet text says 280% (historically 200%). The Erhebungszeitraum from which 280% applies (§ 36 GewStG) was not checked.
- FX rule: no official source fetched.
- Gewerbeanmeldung / Fragebogen steps and Gewerbesteuererklärung filing threshold: secondary or not fetched.
- Whether non-taxable foreign B2B services count toward the § 19 UStG Kleinunternehmer Gesamtumsatz.
